Terms of Service

1. Agreement to Terms

By using Kindred Scenes, whether with an account or by adding content through a share link, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the service.

2. Description of Service

Kindred Scenes lets you collect photos, videos and voice recordings from family and friends and turn them into an edited video. People you invite can add content through a share link without an account. Content is analyzed automatically to build the video, as described in the Privacy Policy.

3. Beta Service

Kindred Scenes is currently in beta. The service is provided "as is" and may change, be interrupted, or contain bugs. Features, limits and prices may change during the beta. We are working to improve the service but cannot guarantee uninterrupted availability during this period.

4. User Accounts

• You must provide accurate information when creating an account
• You are responsible for keeping your account credentials secure
• You must be at least 18 years old to create an account
• One person may not maintain multiple accounts

5. Your Content

• You keep ownership of the photos, videos, recordings and music you upload
• You give Kindred Scenes a license to store, process, analyze and display your content only to provide the service to you and the people you share it with. This includes processing by the service providers listed in the Privacy Policy.
• You confirm that you have permission to upload your content and to include the people who appear in it
• For tribute videos, face recognition is used only after you agree to it in the app, as described in the Privacy Policy. By agreeing, you confirm you have the right to use the photos of the people you add for that purpose.

6. Contributors

If you add photos, videos or recordings through a share link, these Terms and the Privacy Policy apply to you. The project owner controls the project: they can use what you add in their video, and they can remove it.

7. Music

• If you upload music, you confirm that you own it or have a license that lets you use it in your video and share that video
• Music from our library is provided for use in videos you make with Kindred Scenes. Do not extract it or use it anywhere else.
• Platforms such as YouTube may flag or mute music in videos you post there, even when you have the right to use it
• We may remove music that we believe you do not have the right to use

8. Plans, Limits and Payments

• Some features are, or will be, available only on paid plans
• Nothing is charged during the beta. Prices shown in the app are the prices we plan to charge later.
• When paid plans start, each will be a one-time purchase for a single project, not a subscription. We will update these Terms before anyone is charged.
• We may set limits on uploads, timeline rebuilds, video length and other usage, and we may change those limits

9. Acceptable Use

You agree not to:

• Upload illegal, harmful, or offensive content
• Violate the privacy or intellectual property rights of others
• Attempt to access other users' accounts or data
• Use the service for unauthorized commercial purposes
• Attempt to reverse engineer or compromise the service
• Use automated tools to access the service without permission

10. Content Removal and Copyright Complaints

We may remove content that breaks these terms without prior notice, and we may close accounts that break them repeatedly.

If you believe something on Kindred Scenes uses your copyrighted work without permission, write to hello@kindredscenes.com with a description of the work, where it appears on Kindred Scenes, and how to reach you. We will review it and may remove the content.

11. Privacy

Please read our Privacy Policy for what we collect, how it is processed, and your choices, including how face recognition works in tribute videos.

12. Third-Party Services

By using the YouTube upload feature, you agree to the YouTube Terms of Service. Importing from Google Photos is also subject to Google's own terms.

13. Intellectual Property

Kindred Scenes and its original content, features, and functionality are owned by Kindred Reels LLC and are protected by copyright, trademark, and other intellectual property laws.

14. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, Kindred Reels LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

16. Changes to Terms

We may update these terms from time to time. We will tell users about significant changes by email or in the app. If you keep using Kindred Scenes after a change, the new terms apply.

17. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
